“QUIET SEND-OFF”

Liquor at a Party POINT OF LAW INVOLVED The question whether it is within the law to accept monetary contributions in connection with a social function at which intoxicating liquor, purchased for the purpose, is consumed, was involved iu charges heard in the Waihi Police Court, when two young men, Gordon Meuzies. of Auckland, barman, and Eric Rowe, Waihi, miner, pleaded not guilty to a charge of selling liquor without a license in November last. Evidence showed that a committee of young men was formed to arrange a farewell to Menzies, who was leaving, the town. A hall was engaged by Rowe and a door-keeper appointed who act cepted contributions for the purpose of defraying the general expenses of the function, including a presentation, no fixed charge being made. A sum of £3/15/- was handed to Menzies, who was employed at a hotel, to purchase liquor. Constable Welch said he Interviewed Rowe, who stated that Menzies had suggested the send-off himself and that some had paid 2/6 each and others 5/-. Constable Parker, who visited the hall during tbe proceedings, said he was informed that a keg of beer was missing, and that the barman, having consumed too much liquor, had resigned. (Laughter.) Menzies informed him that he was the guest of the evening. Tiie caretaker of tiie hall, in evidence, stated that Rowe had engaged tbe hall for a “quiet send-off.” (Laughter.) Certain damage was done and a few windows broken.

Counsel said members of the committee agreed that Menzies had ordered liquor at their request. This was the first prosecution of the kind made during six six years’ residence in the town. Mr. F. W. Platts, S.'M., reserved his decision.
