CARTING CONTRACT
Shingle and Sand SUPREME COURT CASE While not awarding any damages in respect of the abrogation of the contract for carting shingle and sand, Mr. Justice Blair gave judgment in the Supreme Court yesterday for the Cunningham Carrying Company against River Shingle and Sand Ltd. for £1360 15/7 for work done; interest, etc. Against that amount, said his Honour, credit would have to be given for the instalments paid by the defendant company on the trucks taken over by them from the plaintiff company. His Honour held that the schedule of prices for carting eliminated the possibility of the Shingle Company carrying on business under the present conditions. The Carrying Company had not proved any damage in respect of the abrogation of the contract. Mr. F. C. Spratt ws for the plaintiff, and Mr. R. E. Harding for the defendant.
