SUPREME COURT CASE t The attention of the Chief Justice, Sir Michael Myers, was taken up in the Supreme Court yesterday in hearing an originating' summons to determine who are the persons entitled to participate m the distribution of the residuary estate of Thomas Carter, sheep-farmer, late of Burleigh. Marlborough. The plaintiffs .were Redwood Felix Goulter, sheep-farmer, of Lake Timara, and Henry Howard, accountant, of Blenheim, the trustees of the will, and the defendant was William Stainton Walker, car proprietor, of Rongotea. Mr. W. T. Churchward appeared for the plaintiffs, Mr. C. H. Mills for Ada Walker or her descendants, and the defendant. and Mr. Rose, representing the Public Trustees, for all the beneficiaries. The trustees, in their affidavit, said that Thomas Carter died on February 27, 1900. and his will and five codicils were proved and probate granted in March, 1900. Catherine Carter, the widow of the deceased, died at Blenheim on or about November. 1917, and Ada Owens, the adopted daughter of the deceased, died at Timaru on June 8. 1930. The estate of the deceased now consisted of the following:—Money at the Bank of New Zealand and on fixed deposit, £194,853; moneys in Bank of New Zealand in current account. £lOO/15/10; real estate comprising the farm lands known as “Burleigh," near Blenheim, valued at £7500; total value. £202,453/15/10. As far as could be ascertained, 61 persons.were entitled to participate in the distribution of the estate. An order was made according to the draft agreed upon by counsel in the case, and submitted to his Honour.
