QUAKE FIRE LOSS

Insurance Issue POSITION OF STATE “No Obligation to Pay” The Prime Minister, the Right Hon. G. W. Forbes, stated in an interview with “The Dominion” yesterday, that his attention had been drawn to certain statements which were being widely circulated that the State I ire Insurance Office was bound under the terms of its policies to compensate policy-holders for losses suffered from fire resulting from the Hawke’s Bay earthquake, and it had been suggested that the Government in undertaking to make ex gratia payments was influenced by this. The Prime Minister stated that he desired to make it quite clear that no such consideration influenced the Government’s decision; in fact, the Government was advised that no such liability existed. Insofar as the liability for losses arising from earthquake was concerned, Mr Forbes said he desired to emphasise that liability for fire losses was not undertaken by the State fire. office under its ordinary fire policy. Where such liability was undertaken, special provision had to be made and an additional premium charged, as was the practice of other insurance offices. The Government’s action was entirely prompted by the unprecedented circumstances which arose at Hawke s Bay and it was with realisation that the ’ State fire office was not legally losses that it was decided to make n'lvment which was purely ex gratia. P The Prime Minister added that the whole position had been the subject of review by the Crown Law Office. An oninion which had been given by Sttor-General completely confirmed theX that the State Fire Office was not legally liable under the conditions of its ordinary fire P Ol c ? for by fire caused by earthquake.
