Motion for Retrial Dismissed Saying that he had come to the conclusion that there had been evidence to go to the jury, and also tha't it. was evidence upon which reasonable men could have come to the conclusion that bad been reached, Mr. Justice Ostler yesterday dismissed a motion for a nonsuit and for a new trial on points previously raised and reserved in a case heard, on November 6 last, in which a jury awarded Ernest Drew,'packer, of Wellington (Mr. H. Boys). £413/18/6 damages against G. P. Ciapcott. insurance inspector of Masterton (Mr. Parry). The case was a sequel to au accident in which the plaintiff, who had been 'riding a motor-cycle, was injured after a collision with a car driven by the defendant. His Honour entered judgment for the plaintiff »for the amount found by the jury.
