DRIVER EQUALLY TO BLAME
SEQUEL TO MOTOR COLLISION. In the Magistrate’s Court yesterday, morning, before Mr, E. Page, S.M., Mrs. Florence S. Newton, of Onepu Road, Wellington (represented by Mr. O. C, Mazengarb), proceeded against G. Sunderland, of Masterton (for whom Mr. W. H. Cunningham appeared), to recover £37 10s. for cost of repairs to a motor-car injured in a collision with defendant’s car on the road near Makara in October, 1928. Defendant counter-claimed for his repairs, £9 12s. sd. It appeared that plaintiff was proceeding out to Makara, and defendant proceeding towards' the city, when the two cars met on a bend in the narrow road, and a collision occurred before the ears could pull up. After hearing evidence, the Magistrate held that the drivers of both cars were equally to blame, and that each should pay his own damages and save judgment accordinglv for defendant on the claim, and plaintiff on the counter-claim, without costs.
