Invercargill, February 25. At the Supreme Court, before Mr. Justice MacGregor, the hearing commenced this morning in a claim of £5OO special damages for the loss of customers and £lOOO each general damages for a libellous publication from the “Southland News” Company and the "Southland Times” Company arising out of a statement made at the Farmers’ Union executive meeting that the Southland Farmers’ Cash Supply Service “was a swindle.” The statement was published by both papers. His Honour first heard argument on the question of privilege, which it was contended by the counsel for the defendants ought to apply to this case. His Honour decided against this, nnd the defence rests on a plea of justification. Lengthy evidence is being heard.
