NEW TRIAL SOUGHT

Recently, in the Supreme Court, a jury awarded Miss Motley £497 damages, in respect to injuries received through a service car, in which she was a passenger, running off the road near Paraparaumu. In giving its decision, the jury found that McClelland, the driver of the vehicle concerned, had been negligent, and that Mr. Elliot, his employer, was, therefore, liable. Yesterday, in the Supreme Court. Mr. A. M. Cousins, who represented Elliot, asked Mr. Justice Ostler to grant a new trial, on the ground that the verdict of the jury in respect to Elliot's liability, had been against the weight of evidence. The Court reserved its decision. Mr. H. F O’Leary appeared for Miss Motley, to oppose the motion.
