UNLICENSED TRACTION ENGINE

In giving reserved judgment in a case in which William J. Bowman was charged with using an unlicensed traction engine on the Yaldimrst Rond, contrary to section 7 of the local bodies heavy traffic by-law, A r. Alosley. S.M., convicted defendant and ordered him to pay costs. Air. Alosley said that all the general facts were admitted. It was contended. however, that the traction engine iu'question came within the provision of section 7, and was therefore not required to be licensed. "I am unable (■ give the paragraph referred to the wide interpretation sought to be placed on it by defendant's counsel. Reading the proviso as a whole I can only come to the conclusion that it must be rend in a restrictive sense. In the ease before the Court the trattion engine is used for contract farming. £o exempt the contractor would be to create a much wider exemption than the bylaw contemplated.”
