LEAVE TO APPEAL REFUSED
« CONVICTION STANDS Yesterday the Court of Appeal refused leave to appeal against tlie decision of Mr. Justice Sim, at Invercargill, when ho declined to state a case lor tho Court in the conviction of Walter Yelds for attempted carnal knowledge Yelds was convicted on two counts, and it was submitted by Mr. O. Heed, of Invercargill, that Yolds’s actions were more in tho nature of preparation for an ofi'enco. . The Solicitor-General (Mr. A. hair, K.C.) was not called upon by the Court, and without leaving tho bench Mr Justice Herdman stated tho view of the case with which the other Judges concurred. Mr. Justice Herdman held that the case was in no way different from a leading case which had been cited in argument. . The Bench consisted of Their Honours Mr. Justice Sim, Mr. Justice Herdman, Mr. Justice Adams, and Mr. Justice Ostler. Mr. Justice Ostler stated that he concurred, but with some hesitation, nince the cape appeared to him to be on the borderline.
