"It seems to me that neither under sections 164 or 327 of the Municipal Corporations Act, nor under Section 119 of the Public Works Act, nor by the conjoint effect of all of them, has the council any legal authority to create a nuisance by the creation of the proposed bridge. The injunction therefore is granted with costs, which I fix at £35 and disbursements.” His Honour Mr. Justice Stringer gave reserved judgment in the Supreme Court to-day in the case concerning the proposal to build a new ferro-concrete bridge over the Avon at New Brighton. His judgment will prevent the New Brighton Borough Council from building the bridge unless the decision is appealed against successfully.
