DESTITUTE PERSON SEEKS SUPPORT
Mr. E Page, S.M., gave a decision in the Magistrate's Court yesterday regarding a complaint by a destitute person against an estate, which is subject to a protection order made under the Aged and Infirm Persons Protection Act, 1912. The complainant in the case is the mother of the defendant, and she asked the Court to grant her a maintenance order, declaring that she is a destitute person. The estate _of the defendant is subject to a protection order, with the Public Trustee ns manager. “I can find nothing in the Act to justify the contention that a protected person is released from the liability to be proceeded against under any statute or at common law; nor is' there in the Act any substituted procedure under which the complainant could pro coed,” said Mr. Page. “It seems to me that except ns expressly stated by the Act. a protected person may still he sued nt common law (as for a tori) or proceeded against for a statutory liability, as in the present ease.’’
