LAND AGENT BEFORE COURT FOR SENTENCE QUESTION OF RESTITUTION On a charge of fraudulently converting moneys to his own use, Frederick Joseph Fanning, formerly a land agent, appeared before Mr. Justice Chapman in the Supreme Court on Saturday for sentence. Mr. H. F. O’Leary, for prisoner, said that Fanning had been in business for a large number of years and had never before been faced with a criminal charge. Ho had admitted his guilt, and made every endeavour to redress the wrong ho had done. Intoxicating liquor nffccted him more than usual, and at times deprived him temporarily of his reason. During the last three months he had actually been in a mental institution, and although he was regarded as quite normal at the present there was no doubt that he had been on one of those unfortunate bouts when he converted the money to his own use. He was not in a position to pay the money, as he had been adjudged a bankrupt, and was a married man with a family. When liberated he fully intended to re-establish himself in the community. His Honour: Has anything been done by way of restitution ? Mr. O’Leary: Something might possibly be done by his relatives and friends. His Honour: I think this is a case in. which, if you ask for probation, this man’s friends should coma forward with some' offer, and perhaps it will be advisable if I withhold my judgment in the meantime.

Counsel agreed to report on the matter in a week’s time.
