Senior-Sergeant Lander said that, the complainant -vas engaged on gangway duty on the vessel when the accused assaulted him. The complainant was a. free labourer a,nd the accused a. unionist. In evidence, the complainant stated that at about 11. p.in he advised Fisher, who was then proceeding up the eangway, to be careful of the slippery tar patches, but the only reply he received was that he was “a scabby .” “I had both hands in mv pockets,” said complainant,, “and ho struck mo on the right jaw with his fist.” Accused (from the dock) : “He don’t look much like it.” Fisher assorted that the complainant had refused him admission to the boat, so he had merely brushed him aside with his arm and gone a.Board.
