IN DIVORCE
APPEAL FOR ALIMONY. An appeal for alimony in unusual circumstances came before His Honour Mr. Just'co Hosking in the Supremo Court yesterday in the divorce su’E Cyril James Phelns v. Ivy May Pholns and Christopher Shannon. Air. C. A. L. .Treadwell appeared for the petitioner, and Mr. G. Toogood for the respondent. Tn the original proccodhigs by the petitioner for divorce, Phelps accused liis wife of adultery. The respondent I enuntor-poti! ioncd on tho ground of the alleged adultery of the petitioner. This was denied. The case came up for hearing before Mr. Justice Herdman and a jury of 12 on May 13 last when the jury found for the petitioner, and His Honour gave a decree nisi with costs against the Co-respondent on the higher scale. The respondent now moved for permanent alimony, on the ground that she was destitute. Tim petitioner denied til's alleged condii'on and suggested that she was still living with Shannon, and could earn her own liviim if she chose. His Honour reserved judgment.
