OVER-LOADED VEHICLE
CARRIER FINED £5. Reserved Judgment was delivered by Mr. F. K. Hunt, S.M., in the Magistrate’s Court yesterday in the case wherein the Hutt County Connoil proceeded against S. J. Hayill for driving a vehicla having a weight of more than tons on each wheel over the Paekakariki Hill. The Magistrate said he had carefully perused the by-law on tho subject, and was satisfied of its validity. Defendant must be convicted. On the. question of the fine to be imposed, it was noticed that the council had fixed the fine without any consideration of the Court. ■ Mr. O’Donovan, for the defence, submitted that the by-law could not control the decision of the Court in that regard: it was repugnant to the system of justice. Defendant was fined"- £5 and costs.
