NEW EVIDENCE AT THIRD TRIAL. By Telegraph —Press Association. Hamilton, September 15. The third trial of Ilakaria To Kahu, charged with tho murder of Patrick Richard Elliott at .Ongaroto on Easter Sunday, was continued to-day. Thomas Donnelly, a new witness, said that during September last ho was a ganger in charge of the ..river gang during the • absence of Elliott, on holiday. Prisoner was a member of tho gang. On tho night Elliott returned prisoner said he wanted to get away, but had not enough money to go, and nkked Elliott to buy hie ('prisoner’s! gun for £4. He reduced the price to £2. at which figure Elliott bought it. After the deal witness went outside the whare and prisoner followed, and said: "By God, Himi, the mean ——; I will get even with the mean yct.V Prisoner userl to get stores in witness’s name, witness deducting the cost from his wages. Prisom-r was very fond of shooting, more for shooting’s sake than for game. In answer Io Mr. Hampson, witness said the term used by prisoner in relation to Elliott was just rough and reedy, and cne familiar to bushmen. The evidence was expected to finish to-day, and counsel will address tho Court to-morrow.
