CLERK PLEADS GUILTY MONEYS IN BANKRUPT ESTATES STOLEN Frank 0. Emeny was charged in the Magistrate’s Court yesterday, before Mr. I. Salek and Captain Hennah, Justices of the Peace, with having stolon four separate sums of money totalling ASS Us. 3d. belonging to bankrupt estates in course of being wound up by tho Official Assignee in Bankruptcy.. Mr. P. S. K. Macassey appeared for the Crown, and Mr. A. B. Sievwright for the accused. Mr. Macassey stated that the accused had been employed as a clerk in the Official Assignee’s office during the absence on holiday of the Official Assignee. He had the winding up of four estates, and there were four charges against him —of embezzling T 6 3s. Bd., Al 3 7s. 7d„ d!4O, and A 29.

Samuel Tansley, Official Assignee in Bankruptcy, said that the accused had been employed by him from November 9 to December 13. 1920, winding up certain bankrupt estates: he collected several accounts. On various dates he received cheques for and on behalf of several estates, and had failed tj account for four sums, totalling «£BB Ils. 3d.

Cross-examined: The accused was temporarily engaged io carry on the duties of Official Assignee. He was paid T 4 per week. William 11. Fisher, accountant for the firm of Bell, Gully, Myers and O’Leary, said that on January 17, 1921. he paid n cheque of the value of T+9 14s. to the accused and received a receipt. Alexander L. Wilson, auctioneer, said that on January 25 last, he paid the accused a cheque for .£l3 7s. 7d., and witness produced a receipt for the amount given by the accused.

After evidence as to the character of the accused had been heard, the accused pleaded guilty and was committed to the Supreme Court for sentence. Bail was allowed as previously.
