The Court of Appeal yesterday upheld the nonsuit granted by Mr. ..lustico Chapman in the cute of "Elizabeth Emma Headford, of' Auckland, v. A. H. Nathan, Ltd. , In the Supreme Court at Auckland Mrs. Iteadford claimed .£2001) darnivgaA in respect ol' the death of her husband, a waterside worker. A jury found ITiat sbo was entitled to .CIBOO, but Mr. Juatico Chapman nonsuited her on tho ground that there was no evidence of negligence on the jiMit of the defendant. I'hiintiir appealed,-and argument in sup-, port of her case was laid before tho Court of Appeal by Mr. P. .T. O'Hcgati on Monday. Yesterday the Court nniiiounecd that' Mr. 11. I'. Richmond (counsel for the respondent) need not reply, as the Court had decided that tliore was no case to answer. The appeal was (lipmi&cd, with costs on the highest scale.
