AN INSURANCE'CASE. . YcsLcrday further ' argument was hoard by tho' Court of Appeal in. tlio caso Now Zealand Insurance Company, Ltd., v. tlio Tynesido Proprietary, Ltd. It was contended for tho appellants that a judgment given by Mr.-Justice Sim in favour of the respondents was erroneous in fact and.in law. Tlio Court reserved its decision. A CANTERBURY MATTER. Tho Court also commenced tho hearing of an appeal by Thomas B. Fletcher and William Metchor, of Canterbury, farmers, against' another judgment by Mr, Justice Sim.Tho appellants wore in tho Supremo Court plaintiffs in. proceedings agaftist tlio Wainono Drainago Board. Curtain questions relating to tho classification of tho plaintiffs' land for rating puiK poses wore asked in an originating summons, and tho matter was decided by Mr. Justice Sim. in favour of tho board. The plaintiffs took the caso to the Court of Appeal, which they (asked to review the judgment. ■ ■ Mr.-W. E. Kiunernoy (Timaru) .and Mr. T. A. Lucas (Waimato) appearedfor,tho appellants. The respondents wero represented by Mr. S. 6. Raymond, K.C. '(Christchurch) and Mr. H. F. von Haast (Wellington). ' Tho case was not concluded when tlio Court adjourned.
