CIVIL OASES. Reserved judgment was delivered by Mr. W. G. Riddell, S.M., in a civil case in which tho Official Assignee in Bankruptcy of property of T.. J. 0. Gurr, proceeded against Scott Bros., ■Ltd., and tho Atlas Bisouit and Confectionary Co., for £57 2s. 4d. The defendants aro owners,of tho business of tho Atlas Biscuit and' Confectionery Co., of Christchurch, and were creditors who proved in Gurr's bankrupt estate. In the winding up of the estate tho amount -available for distribution was £5-17 13s. 6d. ; and dividends amounting to 4s. 33d. in tho £ -wore declared by the plaintiff in favour of t'lio creditors who proved in the bankruptcy. Defendants received as their share £219 6s. 5d., and the funds available for distribution wore almost exhausted when, tho dividend had been paid. • Subsequent to the distribution o£ the dividend it was found that the proof of debt of the Frimley Canning Co., of Hastings, amounting to £910 Os. 9d., had been omitted owing to a mistake of fact on tho part" of plaintiff. The proof of debt should have been £3448 ss. 7d„ instead of £2538 4s. 10d., and had tho proof of the Frimlov Canning Co. been included, the divident payable to defendants would have been £164 4s. Id., instead'- of £219 6s. sd. The plaintiff claimed the return of the excess payment made to defendants amounting to £57 '2s. 4d. His Worship held that the proof of tlio Frimley Co. should have been included among the list of creditors, and were entitled to share in the bankrupt estate. Defendants had submitted that the omitted creditor Mvas entitled •to bring action against the other- creditors, but that the proper course was to apply to the Supreriio Court in Bankruptcy for such an order.' The Magistrate agreed with this procedure, quoted authorities on the' question, and finally stated that plaintiff must apply to the Supreme' Court to have the dividend sot aside; the.
