At the hearing of the claim two defences'wore set up:—l. That tho deceased 'was not tie husband, of tl— plaintiff. 2. 'Iliat the plaintiff was not a dependent of the deceased. Ia the course of. judgment, the Court held that it was true that Mrs. Carietcffl had not received any support from tlio deceased, for years, and that although sho eaused inquiries to ho made for him from time to limo &lie did not ta.ke any steps to eaiforco ljer legnl rights as sisß might have dsi.re. Nemtljeless, the Gourt was satisfied,tlmt she had »ot in u.«y way abanitojied s sueii rights, aitd tliat having become incapable of assisting to nniiiitaiii herself by iwr awn labour, as a result of a scii* ous operation in November, 1912, t'tiSTe was at the time of her husband's death, and for some time before, a fair probability that her legal rights tto-tiid have been actually and effeVlivoly assorted by her if sho had discovered her husband's whereabouts. The Court - awarded £100, with costs.
