DEADLOCK
ON RAILWAY APPEAL BOARD. (By Tolograßh.—Press Asaootation.) Palmerston, March.2s. ■The Railway Appeal Board commenced its -sittings hare this .afternoon,'. Mr.' HaSeMen presiding. .Mr. C. P. Ryan represented tho, first 'division, Mr. D, Dwyer the second division, and . Mr. Davidson appeared for We Department. ,Tho first a'ppeal'was clerk at Lambtori Station; Wellington. Ho was represented by Mr. Hanlon, and appealed against , the withhojding.of a .'reoommenclafcion for''promotion to the' .neixt.. sub-grade. . ~> . \ . Discussion ensued as to whether Mr. Duncan, Traffic Manager, ishould bo allowed to sit alongsido Mr. Davidson and coach him, seeing that he was to give evidence against the appellant. .. The Magistrate ruled .that Mr. Duncan had a right to he there.! Mr. Ryan objected, and quoted Subsection 3 of Section 63 of tho Act, with a view, to showing that, the Department's case had to be conducted by some member appointed by the Minister on behalf of the Department. , Messrs,. Dwyer and Ryan left the Bench to con for, .a deadlock ensued, and, after an hour's adjournment, no mutual arrangement l had been' arrived at, and the Court was. adjourned till next morning. ' The Magistrate stated that the point would have to "bo settled once and for all.
