OYER A CHEESE CONSIGNMENT.
INTERESTING POSITION. (By Telegraph.—Press Association.) Dunedin, September 14. A case arising through an agent deferring the sending of a cable stopping the sale of his principal's choose, occupied the attention of tho Magistrate's Court today. It was alleged that defendant had acted as agent for plaintiff in consigning and selling cheese. One hundred and ninety-nine cwt. of cheese was delivered for consignment to and sale in London per s.s. Arawa on January 17. Plaintiff had instructed defendant to stop the sale of the shipment by cable. Defendant, according to the statement of claim, did not carry out this instruction, and tho chccse was sold at. 575. Gd. per cwt., whereas, if the instructions had been carried out, it would have roalised Gls. per cwt. Plaintiff, therefore, claimed the difference on 199 cwt., amounting to .£34 IBs. Gd. The defence was that defendant, M'Ewan, had advanced sd. per lb. on tho shipment, and thus had control over it. so that it was not ncccssar.v to consult plaintiff. Decision was reserved.
