Hayes was charged ■ with : conducting a game of change on a racecourse on . SeDtember 29. •• Accused, it was nlleged/.Tiad a glass case in which he displayed various articles as prizes. On the glass top of the case wero cortain numbers, and competitors who circled these numbers,with steel rings, (eight shots for a shilling) thrown from a distance of two or three yards, became entitled to prizes of various values.' Jj : ■ The police contended-that it was a galine of chance inasmuch as skill at it could only be obtained after a- long time, while the glass surface increased the chance.' Counsel for defendant: contended that it was purely, a game'of ' skill, but the magistrate (Mr. Kerr) sjud that he. had no difficulty ,in comings'tii; a decision that tho game was an ulilawtul one, and,- in the nature of a wager, with all the chances against the thrower. .
