He pleaded not' guilty ._to all three charges, and conduilted his own defence. , Harold Palethorpe, stated that after 10, p.m. on September 9 he was standing on Lambton' : Quayi, 'opposite' Macdonald's Mart, in company■' with a lady waiting for the car., He -noticed a motorcar'approaching at a great speed. .'lt was -on its correct sida till it - got near ..-'the United Farmers' corner,. when. it swervtd towards' the- centre of. the road, ;and struck witness. 1 From the time he. sawit. until it reached, him. it/seemed'only about four or five seconds. _ Its' speed was more like an express train than anything else. ■-•'.•/. It seemed 'to me like a great blaze of light,, and then, :I was asking for 'a. drink of water .on the other ,side of'lambton Quay. .' • • Witness added that the lady who.,was with ..him was also struck by the car. 'A car had previously passed between the /spot where they were standing and'the/ footpath. Horace Rogers,'tram motorman,. stated :in-evidence that, while, his car was travelling from-10• to 12 miles nn hour, the taxi-cab came from behind and passed him quickly. Two 'other witnesses also gave evidence for the police.
