IMPORTANT INDUSTRIAL DECISION. Auckland, April 21. Judgment was given to-day in tho Arbitra* tion Court in a case in which the hotel andl s restaurant employees asked for an -award. Judge Sim said the employees had refused to discuss the matter before tho Conciliatiott Council or to assist in bringing about'' g, friendly settlement of- tho dispute. Tho question was whether the Court in these oircumstanccs should proceed further with the dispute. Tho technical demands of the" aw had been complied with; but the Court had power to refuse'to mako an award. Tho ' most important provisions of recent legislation were those dealing with conciliation, and tho Court would not allow them to be treated as a dead letter. Tho present application would bo dismissed, and not until the Coni " ciliation Council had failed to settle a case would the Court hear a'dißputo. This course would bo adopted in.all similar cases.
