« — Wednesday, Bth Jan. , 1879. (Before E. H. Carew. Esq., R.M.) Munro v. Daly and Another. — Claim, Ll7 13s Gd for goods sold and delivered, board, and rent of cottages. Mr Reid for plaintiff ; Mr Taylor for defendants. This case had been adjourned on Mr Taylor's application from the 18th December, when the defence was only partly heard. Patrick Daly, one of the defendants, was examined, and said he objected to pay board for one of the men for whose board he was charged. He. (Daly) did not in any way make himself responsible for this man's board, or he would have kept it out of his wages. He never agreed in Mr Gr* : ig's presence to pay the account produced, but only to pay for horse hh*e. He denied receiving the goods, and never authorised Mrs Silk to get the goods for him. He boarded with Mrs Silk and paid her, and did not take the house or become responsible for the rent. In cross-examination Daly contradicted himself in several particulars. John Heron denied promising plaintiff to pay the rent, and knew very little about the other items claimed for. Bartley Morris was also called, but his evidence was unimportant. The plaintiff was recalled as to the payment of a sum of L 6 19s, which he said was only on account of the money then due. His Worship gave judgment for Ll 6 8s Gd ; costs of Court, 21s ; witness' expenses, 10s, and professional fee, 21s. BILLIARD LICENSE. A.
