Man charged with killing unborn child

A Timaru man, aged 18, has been charged with killing an unborn child. The charge relates to an assault on a Timaru woman, aged 19, last Tuesday and is thought by police to be the first instance of its use in New Zealand. The charge has been laid under section 182 of the 1961 Crimes Act

which provides for a maximum sentence of 14 years imprisonment. The act refers to anyone “who causes the death of any child that has not become a human being in such a manner that he would have been guilty of murder if the child had become a human being.” Sergeant Ross Glendining said that police

and several police legal section advisers in Wellington had not heard of the charge being used before in New Zealand. The woman, who was 26 weeks pregnant, is still in Timaru Hospital. The man, who is also charged with assault with intern to cause grievous bodily harm, will appear in the District Court at Timaru this morning.
