Connell injunction stands

NZPA-AAP Perth One of the matters Laurie Connell was to attend to in London this week involved the purchase of the shell of Rothwells Ltd, the Western Australian Supreme Court was told. Tom Hughes Q.C., for Connell, said an interim injunction granted to the National Companies and - Securities Commission last Friday barring the businessman from travelling overseas had “frustrated” planned meetings in London on Monday. Connell unsuccessfully applied to have a hearing on

the matter brought forward from Thursday. Connell said in a 103-page affidavit lodged with the NCSC on Monday that the transactions he was to have attended to in England involved "the purchase by a third party of the Rothwells corporate structure,” Hughes told the court. The injunction prevented Connell from taking a British Airways flight to London on Friday as he had. planned. Hughes told the court no evidence had been submitted by the NCSC that Connell had

intended “making away” and not returning. He argued that the hearing should be held there and then to enable Connell to leave for London as soon as possible. Kulen Ratnesei, for the NCSC, said there was “not a tickle” of evidence Connell had to leave before Thursday on urgent business. Mr Justice Rowland agreed Connell had not shown any "urgency” as to why the matter had to be brought forward. He dismissed the application.
