NZPA Washington The New York Yacht Club strongly supports the New Zealand challenge contention that defence of the America’s Cup with a catamaran was improper and says the Cup should go to Michael Fay by default. In an affadavit filed with the New York State Supreme Court, the club commodore, Frank Snyder, said the purported defence of the Cup in September by San Diego Yacht Club “was improper because the result was a foregone conclusion.” The event was “no contest” and therefore not a match within the meaning of the deed of gift which governs the Cup racing, he said. Today is the final day for legal submissions to the court which is being asked to decide whether San Diego was entitled to defend the Cup with a catamaran.
