Cup battle due in court
NZPA-Reuter San Diego Lawyers for the San Diego Yacht Club and New Zealand’s Mercury Bay Boating Club will consult a New York judge on October 12 at the request of Michael Fay, leader of New ' Zealand’s failed America’s Cup bid. Representatives of both sides told Reuters the lawyers would meet before a judge of the New York State Supreme Court, which has jurisdication over the yachting dispute under the America’s Cup charter’s Deed of Gift.
Fay requested the meeting to discuss the lopsided Cup series, won by San Diego skipper,
Dennis Conner and his crew, earlier this month.
San Diego’s 19m catamaran beat New Zealand’s 40m sloop 2-0 in a best-of-three series that ended on September 9. Fay contends the disparity between the boats made the event a mismatch and that San Diego’s win should be nullified. “We’d like to see DSQ engraved on the Cup next to San Diego Yacht Club’s name,” Fay’s lawyer, Andrew Johns, told Reuters. The letters represent the word disqualified. Fay has yet to file a lawsuit he had vowed to lodge immediately after the races.
