Court overturns man’s sentence
PA i Wellington The Court of Appeal has quashed a prison sentence against a man who kickied a woman, aged 60, in the stomach and hit her on the head, thinking she had pushed an icecream into his baby’s face! !
Delivering the i Court’s judgment last week, Mr Justice Gallen said the circumstances of the case against Paul Joseph Dally were “extremely unusual.” It 'would be difficult to
think of a stronger emotion than that which arises when a parent sees a need to protect a young child. A jury at a defended hearing’ in the District Court at Auckland on November 17 convicted Dally of injuring the com-
plainant. He was sentenced to one year in prison, j , The Appeal Court judgment overturned that sentence and put him on periodic detention for nine months.
