Critic applawds Govt decision

The senior University of Canterbury law lecturer who initially questioned the legality of Government moves to end tax concessions on superannuation schemes was yesterday delighted with the decision to defer the proposal. On Wednesday, Mr Philip Joseph claimed that a 1976 Supreme Court case successfully brought against the then Prime Minister, Sir Robert Muldoon, by a public servant, Mr Paul Fitzgerald, created a legal precedent which would have made
the Labour Government’s moves illegal. The Prime Minister, Mr Lange, yesterday acknowledged that the question involved constitutional issues—a decision which was supported by Mr Joseph. “We can all be pleased that the Prime Minister has accepted that the Government cannot govern without Parliament’s authority,” said Mr Joseph. “It is surprising that it should have attempted to do so with the precedent established in the 1976 case so fresh in the mind.”
