Appeal resumes
PA Wellington The appeal to allow the merger of Wattie Industries, Ltd, and Goodman Fielder, Ltd, resumed in the High Court at Wellington yesterday after the appointment of a friend of the court — Mr John McGrath, Q.C. — to argue the case for the respondents. The appointment of a friend of the court (amicus curiae) became necessary when the Commerce Commis-
sion and 17 other respondents withdrew from the case last Thursday after reaching satisfactory agreements on divestment proposals with Wattles and Goodman Fielder. The amicus was appointed by the solicitor-general at the request of the court to argue the issue of whether the court had the right to rule on a merger proposal which was now different from the one rejected by the Commerce Commission. The hearing continues.
