The slope of the land ’ exceeds 15 degrees, and the ’ earthworks carried out in • the area were completed without the specific consent of the Council as required and has left the area In a very unstable AND THAT there has been a breach of section 94 of the Town and Country Planning Act 1977. TREVOR ALLEN LINDSTROM Is HEREBY given notice that remedial work Is to be carried out as follows: 1. The proper collection of all stormwater and the trapping of slit and the stormwater being led safely to upper Kent Street. 2. Spoil and scrub dozed over the road reserve banks to be removed. The finished batters are to be trimmed and sown down. 3. Any surface cracking to be tight-filled with clay to restrict water ingress. 4. The areas on Sections PT. 403 and 402 below the adjoining house to be planted with suitable trees and shrubs to assist stability. 5. The area cleared of pines and the area to the east of the pines to be planted with suitable trees and shrubs to assist stability. 6. All bare areas to be grassed. 7. The whole maintained until stability and detritus discharge ceases. Slit traps and water tables to be cleaned regularly. 8. All work to be carried out to the satisfaction of the Plcton Borough Council. The Council is to be kept advised of any time work is being carried out. TAKE NOTICE THAT If there Is a failure to comply with the requirements of this notice within one month from the date of publication of this notice or within such further time as the Council may at its discretion allow, the Council may apply to a District Court for an Order authorising the Council, by Its officers agents or employees, to enter on the land and do or complete the doing of any act or thing required by this notice. The Council may recover as a debt due to It by the person who is then the owner of the land any expenses reasonably Incurred by the Council In doing or completing any act or thing or removing any material or thing pursuant to any order of the Court. Any such debt Incurred may be registered as a charge on the land pursuant to Section 94(8) of the Town and Country Planning Act 1977. DATED at Plcton this 2nd day of DECEMBER, 1986. B. W.
