Public Notices MATAURA RIVER DRAFT NATIONAL WATER CONSERVATION ORDER PURSUANT to section 208 (7) (a) of the Water and Soil Conservation Act 1967 the National Water and Soli Conservation Authority hereby gives notice that It has prepared a draft national water conservation order in respect of the Mataura River. The draft order has been prepared following an application made Jointly by the Otago Acclimatisation Society, the Southland Acclimatisation Society, the Council of South Island Acclimatisation Societies and the National Executive of New Zealand Acclimatisation Socitles; and consideration by the Authority of submissions and objections made in respect of that application. Submissions on or objections against this draft order or any part of it may be made by: (a) any body or person who made submissions on or objected to the applications; (b) any body or person who may be affected by the draft order. All submissions or objections must be made within 28 days after the date of the publication of this notice and must be lodged with the Registrar, Planning Tribunal, Justice Department, Private Bag, Postal Centre, Wellington.

RECOMMENDED DRAFT WATER CONSERVATION ORDER THE NATIONAL WATER CONSERVATION (MATAURA RIVER) ORDER 1986 1. TITLE AND COMMENCEMENT - (1) This order may be cited as the National Water Conservation (Mataura River) Order 1986. (2) This order shall come into force on the 14th day after the date of its notification in the Gazette. 2. INTERPRETATION - In this order, unless the context otherwise requires: “Act” means the Water and Soil Conservation Act 1967. "Protected waters” means: (a) the Mataura River from its source (approximate map reference NZMSI 5142 368340) to the Mataura Island Road Bridge (approximate map reference NZMSI 5177 707053; and (b) the Walkaia River and Its tributaries, and all of the other tributaries of the Mataura River upstream of Its confluence with the Walkala River (approximate map reference NZMSI Sl6O 710673); and (c) the Mlmlhau Stream ' and the Mokoreta River and each of their tributaries. 3. OUTSTANDING FEATURES - It is hereby declared that the protected waters include outstanding fisheries and angling amenity features. 4. RATE OF FLOW OF NATURAL WATER - Because of the outstanding features specified in clause 3 of this order, the following daily mean rates of flow shall be retained. (a) for the protected waters downstream of the confluence of the Mataura and Walkala Rivers; the natural rate of flow less no more than 3000 1/s; and (b) for the remainder of the protected waters; the natural rate of flow less no more than 500 1/s. 5. RIGHT TO DAM NOT TO BE GRANTED (1) A right to dam the Mataura River from its source to the Mataura Island Road Bridge shall not be granted under sections 21 or 23 of the Act. (2) A right to dam any tributary of the Mataura River that forms part of the protected waters shall not be granted under sections 21 or 23 of the Act, if the dam would harm salmonid fish spawning or prevent the passage of salmonid fish. 6. WATER RIGHTS (1) A water right under sections 21, 23 or 24 of the Act may not be granted by the National Water and Soil Conservatory Authority, or by the regional water board (as appropriate), and a general authorisation under section 22 of the Act may not be made by the regional water board in respect of the protected waters if the effect of such water right or general authorisation would be to prejudice the maintenance of the rates of flow specified in clause 4 of this order. Every water right granted, and every general auuthorlsation made, shall be subject to such conditions as to rostering and other matters as the National Water and Soil Conservation Authority or the regional water board (as appropriate) considers necessary to ensure the maintenance of the rates of How specified In clause 4 of this order. (2) Notwithstanding anything in this order, no water right shall be granted, and no general authorisation shall be made if the effect would be that any portion of the fishery or angling amenity of the protected waters ceased to be outstanding. ((3) Notwithstanding anything in this order, it shall be lawful for water rights to be granted, and general authorisations to be made, for the purpose of research into and, enhancement of fish-' erles. (4) Nothing in this order shall be construed as limiting the effect of the second proviso to section 21(1) of the Act relating to the use of water for domestic needs, for the needs of animals, and for or in connection with firefighting purposes.
