Long-life milk not ‘milk,’ says court
PA Wellington Anchor long-life pro-tein-enriched low-fat milk is not milk within the definition of “milk” contained in section two of the Milk Act, the Chief Justice, Sir Ronald Davison, has ruled. The New Zealand Cooperative Dairy Company, Ltd, which markets the product, had sought the declaration which Sir Ronald made. In a reserved judgment
in the High Court in Wellington, Sir Ronald said that if the product was milk it fell to be controlled by the New Zealand Milk Board, the defendant, under the provisions of the Milk Act He said that the Milk Board submitted, among other things, that the product was milk either because it fell directly within the definition as “mSk" or as “reconstimilk.”
