Defamation appeal dismissed
The Christchurch Press Company, Ltd, has failed in an appeal against a High Court judgment awarding a total of $102,000 to five members of the Exclusive Brethren for defamation in articles published in 1977.
In a judgment delivered yesterday, the Court of Appeal upheld the decision of Mr Justice Roper in 1983 to award Mr A. J. Smith $35,000, Mrs M. L. McGaves-
ton $30,000, Mr H. R. McGaveston $15,000, Mr A. R. Lewis $12,000, and Mr P. G. B. Suckling $lO,OOO. The appeal was heard by Mr Justice Cooke (presiding), Mr Justice McMullin, and Mr Justice Tompkins. The Court was unanimous
in its decision on Mr Smith, Mrs McGaveston, Mr McGaveston, and Mr Lewis. Mr Justice Tompkins dissented from the majority decision on Mr Suckling.
