Retrial ordered

NZPA-AAP Canberra The Director of Public Prosecutions, Mr lan Temby, Q.C., has decided that Justice Lionel Murphy should be retried on a charge of having attempted to pervert the course of justice.

In a brief statement issued in Canberra yesterday, Mr Temby said that his decision followed the decision by the Court of Appeal and the Court of Criminal Appeal of New South Wales that there should be a retrial. However, in the interests of a fair hearing for the High Court Judge, Mr Temby said that he would not present an indictment for at least three months, at which time he would review the situation again.

“I am satisfied that it cannot be earlier than three months from now; the situation will be reviewed then,” he said.
