Man fined $720 on four charges

Fines totalling $720 were imposed yesterday on a man earlier convicted of discharging a firearm in Bealey Avenue with reckless disregard for the safety of others, intentionally damaging a sign, cultivating cannabis, and possessing a PipeJudge Palmer told Dean Alan Lindsay Graham, aged 20, in the District Court that his offending apparently stemmed from his immaturity. Graham, (Mr L. M. O’Reilly) had fired a rifle at an illuminated sign outside a Hare Krishna building on October 5, at 2 a.m. The Judge who said he had seen the particular sign, said he could not see the daamage done to it coming to $BOO.

He adjourned the matter of compensation to December 3 and asked the Probation Service to prepare a reparation report. After hearing counsel’s submission, Judge Palmer said he accepted that the offending was out of char-

acter and unlikely to reoccur. Graham was fined $4OO on the firearm offence, $2OO on the cultivation charge, and $l2O for possessing a pipe for the commission of an offence under the Misuse of Drugs Act. Mr O’Reilly said his client had come under the influence of others with a lifestyle different from his own. The rifle used was not his own and being an extremely good shot Graham had simply demonstrated what he could to impress his associates. Of the 400 cannabis seeds found soaking and ready for planting in the defendant’s room, Mr O’Reilly said others in the flat were involved and that it was largely an experimental project. Mr O’Reilly said the $BOO compensation sought for the sign appeared somewhat excessive and seemed to be a total replacement cost. He asked that no order be made on this amount.
