Minister rejects criticism of Act

PA Wellington The new Criminal Justice Act is not defective in how it treats referral for psychiatric examinations, the Minister of Justice, Mr Palmer, said at the week-end. ■ Mr Palmer’s comment answers criticism of the act by District Court Judge Ron Jamieson. The criticism centred on the fact that the new act enables the court to make a psychiatric examination a condition of bail, but leaves such an examination the choice of the defendant if that person is remanded in custody. A psychiatric report even to Judge Jamieson st week on a person

charged with arson said .that it was hot possible to conduct further examination unless the person was detained in a psychiatric institution. While Mr Palmer said that he would not comment on judicial decisions, he said that he did not agree with the apparent interpretation of the act by the Judge. Meanwhile, Mr, Palmer has asked officials to provide him with an analysis of recent legislation in South Australia on reparations. Reports say that this allows for criminals in the state to have their homes and bank accounts confiscated to compensate victims of their crimes.
