Mr Mahon to study surgery dispute
PA Auckland Mr Peter Mahon has agreed to investigate a dispute between an Auckland widow and the Accident Compensation Corporation. Mr Mahon is the former High Court judge who inquired into the Mount Erebus air crash. The dispute concerns the death of Quenton Heath Brew in August, 1977. Mrs Margit Brew asserts that his death was the result of an error during surgery at Green Lane Hospital. Six years later she had made little progress with the corporation and instead sued the Auckland Hospital Board, a surgeon, and a doctor. The court referred the case back to the corporation, which accepted the doctors’ argument that death was from medical misadventure rather than negligence. In addition, the corporation ruled that Mrs Brew had no compensation cover as of right. She responded by seeking compensation for her own pain and suffering and last year was awarded $25,465. This she accepted, but thought the decision did not go far enough.
