Equiticorp legal move

PA Auckland A High Court ruling is expected today on an application by Equiticorp Holdings, Ltd, to rescind part of an injunction granted against it in an action instigated last week by CBA Finance, Ltd. CBA Finance was granted an injunction preventing its now-dismissed managing director, Mr A. R. Hawkins, and its general manager (administration) Mr K. J. Gillespie, from having any involvement with the new company, Equiticorp Holdings, Ltd, until further orders were made by the court The injunction also prevented Mr Hawkins, Mr Gillespie and Equiticorp from directly or indirectly persuading any employee of

CBA Finance to terminate employment with that company. However, yesterday Mr Hawkins, Mr Gillespie and Equiticorp Holdings, Ltd, sought further orders from Mr Justice Sinclair rescinding the section of the injunction relating to Equiticorp Holdings’ employment of CBA Finance employees. For Equiticorp, Mr Brian Henry, QC, submitted there was no legal impediment to Equiticorp’s employing any staff once any contract with a present employer was terminated. For CBA Finance, Mr Gerard Curry opposed the application, saying there had been clear attempts by staff of GBA Finance to submit inadequate notice of termination
