Leave to appeal
PA Wellington The Privy Council may decide whether the trotting conference’s rules restricting the number of mares that can be served, either by artificial insemination or naturally, by one stallion are valid.
The Court of Appeal found on December 10 last year in favour of a Christchurch stud, Nevele R. Stud Limited, that the conference rule was outside the scope of the Racing Act. Last week, the Court comprising Mr Justice Cooke, Mr Justice Richardson and Mr Justice McMullin, granted the New Zealand Trotting Conference conditional leave to appeal to the Privy Council. The conference must within three months provide security in the sum of $2OOO for the prosecution of the appeal. The Court held that the questions decided by it, by reason of their great general importance, were matters that qualified to be submitted to the Privy Council.
