Help ‘might set bad precedent’

Helping a Sydenham resident to repair his “sinking” house could set a bad precedent, the Christchurch Drainage Board has been told.

The board sought a repair quotation from Mr S. C. Anderson and asked its solicitors for legal advice if it wanted to help pay the bill. Both the board and the Christchurch City Council have denied liability for any subsidence of the house foundations which Mr Anderson blames on the renewal of a drain outside his Huxley Street property several years ago. The reply was that board assistance could “open the

floodgates for future claims of this sort.” Members of the board operations and services committee were yesterday not completely happy with the legal advice. Mr R. Stewart said he had suggested to Mr Anderson that he take his problem to the presenters of the television programme, “Fair Go.”

Instead, the committee recommended that staff offer to help Mr Anderson with information if he wanted to make an insurance claim for his house. An approach to the Earthquake and War Damage Commission was one suggestion.
