Trash bin used in theft

A man who picked up a rubbish bin which he threw through a shop window in order to steal a leather jacket, valued at $225. was sent to prison for four months, when he appeared for sentence before Judge McAloon in the District Court yesterday. The Judge said that the defendant. ■ Waha Peter Howe, aged 23. unemployed (Mr P. Twomey), had an appalling criminal record. “This is the thirtieth offence you have committed in the last three years, and it is your sixth crime of burglary in the same period." he said. The Judge said that he could not accept counsel's submission that the offence was committed out of a sense of frustration. Neither did he consider

recommendations made by counsel, and in the probation report, that a communitybased sentence be considered. In addition to being sent to prison Howe was put on probation tor 12 months.' No order was made for the payment of $463 sought in compensation for the broken window. Mr Twomey said that the offence had been an impulsive act and that Howe did not know why he committed the offence. It was. said Mr Twomey, the second time Howe had committed this type of offence on the same shop.

The knife found in the defendant's possession, when he was arrested, was for his own protection, said Mr Twomev.

Howe had no intention of using it. he said. Howe had admitted breaking into the premises of Natural Wear, in the Cashel Street Mall, and with unlawfully possessing a knife. The offences took place on January 22. CANNABIS CHARGE An English tourist charged with importing cannabis into New Zealand was remanded to February 16. without pleading. David William Hicks, aged 21. is charged with having committed the alleged offence at Christchurch on February 8. The charge, which is indictable. is laid under the Misuse of Drugs Act. Hicks was remanded in custody.

ASSAULT CHARGES A shop manager facing one charge of assaulting a woman, and another of assaulting her daughter, aged 10. was remanded to March 7 for a defended hearing on both charges.
