Drivers to claim costs of appeal

PA Wellington Lawyers for the Drivers’ Federation will have submissions prepared within the next few days which ask the Crown to meet legal costs incurred in the federation’s Court of Appeal wage case. The federation’s advocate, Mr R. J. Campbell, confirmed yesterday that the drivers’ lawyers were going ahead with costs claims, in spite of the Prime Minister’s saying he would give no consideration to the proposal. In making its split decision in favour of. the wage-price freeze regulations, the Court of Appeal noted that if it had

the jurisdiction, ''it would have awarded the federation's costs out of public; funds. However, the Court was not entitled to make such a ruling. Following up the Court's decision, the federation announced that it would not take any further legal action against the Government over the freeze regulations. The federation said it would fall in line with the Federation of Labour-Com-bined State Unions campaign of opposition to the freeze. Mr Campbell warned that this could well mean industrial action’s being taken.
