Victims sue council
PA Auckland A couple who had to leave their home after the Grey Lynn landslip on December 3 have accused the Auckland City Council of negligence and are suing it for $75,000 in damages. Mr Noel Manning and his wife, Margaret, have served a writ on the council as the body which approved the subdivision of the land on which their house is sited for residential use. They are claiming $35,000
to repair the damage to their property at 7 Herringson Avenue. Another $40,000 has been claimed for the devaluation of their house and for “great inconvenience, worry, and strain.” The couple’s lawyer, Mr C. B. Ruthe, of the Grey Lynn Neighbourhood Law Office, said in the claim that the value of the house had dropped from $62,000 to $12,000. He said that Mr and Mrs
Manning had lived in rental accommodation from December until August when they re-entered the house “at risk to their life and safety.” Mr Ruthe said the landslip and resultant damage was a consequence of City Council negligence. The Auckland City Council’s works committee yesterday recommended that the council withdraw an offer of a $35,000 interestfree suspensory loan made to the Manning family in July.
