Attempt to mislead officer

i PA Auckland I I Two youths who attempted I to mislead a traffic officer i about a driving offence I notice issued against one of them were sentenced to prison terms when they appeared in the High Court at Auckland.

Steven John Forsythe, aged 17. unemployed, of Pakuranga, and Dennis Phillip. Oxley, aged 19. unemployed,' of Manurewa. had earlier pleaded guilty in the District Court and been convicted on charges of conspiring to defeat the course of justice.

Forsythe had been apprehended for driving while disqualified and had been summoned to appear in the District Court at Otahuhu.

The High Court was told that Forsythe had feared he would be sent to prison. It was decided between the accused that Oxley would assume Forsythe’s ’ identity and contest the charges.

Oxley had later claimed to the traffic officer who issued the offence notice that he was Forsythe and had not been driving the car on the day of the offence.

Mr Justice Holland sentenced Forsythe to six months jail. He added three months to a 12-month prison sentence being served by Oxley for burglary and theft.
